Judith Bresler, counsel at Withers Bergman, spoke of a report submitted by the Art Law Committee of the New York Bar Association in support of a bill that enhances protections under the law for authenticators. Specifically, the bill adds a new section 13.04 that uses a three-pronged mechanism to discourage frivolous lawsuits brought against authenticators who render opinions in good faith.  Promoting Artist Resale Royalties

Congressman Jerrold Nadler (D-N.Y.) followed next with a presentation on a bill he introduced with US Senators Edward J. The ART Act, as it is called (it is an acronym for American Royalties Too) calls for artists to receive a flat 5 percent of the resale price for works sold at auction for more than $5,000.

Auction houses, among others, have generally been opposed to resale royalties, which they contend is tantamount to an added tax. In addition to raising the cost of doing business, they believe it would chill the existing market for art at auction. Already hurt by the need to provide price guarantees to attract high value consignments, they view the royalties as a further disincentive for prospective sellers who now may be more apt to make private deals rather than going to auction. But EC-11-0535, as the New York Code for endangered species is called, does not intend to snuff out all trade, he said, rather it focuses on poached ivory. “It does not eliminate the ability to issue permits,” said Berkman.
